2. Platform Services

2.1. Service Description

DailyDriven offers the following services:

Editorial Content:

  • Automotive articles and news
  • Guides and tutorials
  • Editorial vehicle reviews

Marketplace:

  • Vehicle sale listings
  • Auto parts sale listings
  • Dealer profile for commercial users

Auto Services:

  • Engine tuning and optimization requests
  • Steering rack refurbishment requests
  • Turbocharger refurbishment requests
  • Electric charging station installation requests

Community:

  • Discussion forum
  • Q&A section
  • Owner reviews and opinions

2.2. Service Availability

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, partially or entirely, the services provided through the Platform, with or without prior notice.

We are not liable to Users or third parties for modification, suspension, or interruption of services available through the Site.

2.3. Service Modifications

We may modify the Site's content and terms of use at any time. New conditions become effective upon publication on the Site and are not retroactive.

3. User Account

3.1. Account Creation

To access certain Platform functionalities, creating a user account is required. Upon registration, you agree to:

  • Immediately notify any unauthorized use of the account
  • Not create multiple accounts or use false identities

We reserve the right to suspend or delete your account if you:

  • Engage in fraudulent or illegal activities
  • Harm other users or the Platform's reputation

3.4. Voluntary Deletion

You may request account deletion at any time by contacting us at [email protected]. Account deletion does not affect legal obligations to retain certain data.

4. Marketplace – Specific Terms

4.1. Nature of Intermediation Service

The DailyDriven Marketplace is an intermediation platform that facilitates the connection between sellers and buyers. DailyDriven is not a party to transactions between users and does not guarantee:

  • The quality, safety, or legality of goods offered
  • The accuracy of descriptions or photos in listings
  • The ability of sellers to sell or buyers to pay
  • The completion or fulfillment of transactions

4.2. Specific Regulations

Marketplace use is subject to specific regulations.

These regulations are an integral part of these Terms and Conditions.

4.3. Seller Obligations

Sellers agree to:

  • Post listings only for goods they legally own and have the right to sell
  • Provide complete and accurate descriptions of goods
  • Honor the advertised price and conditions
  • Respond promptly to potential buyer inquiries
  • Not post false, misleading, or fraudulent listings

4.4. Buyer Obligations

Buyers agree to:

  • Personally verify goods before purchase
  • Not abuse platform functionalities
  • Communicate correctly and respectfully with sellers

4.5. Prohibited Content

Posting listings for the following is strictly prohibited:

  • Stolen vehicles or those of dubious origin
  • Counterfeit parts or those not meeting safety standards
  • Goods infringing intellectual property rights
  • Any other goods whose sale is prohibited by law

4.6. Fees and Commissions

Certain Marketplace services may be subject to fees or commissions. These will be clearly displayed before using the respective service.

5. Auto Services (Tuning, Refurbishment, Charging Stations)

5.1. Nature of Services

Through the Platform, users can request quotes and schedule services with our authorized partners for:

  • Engine tuning and optimization (ECU remapping)
  • Steering rack refurbishment
  • Turbocharger refurbishment
  • Electric vehicle charging station installation

5.2. Relationship with Partners

DailyDriven acts as an intermediary between users and service providers. The contract for service provision is concluded directly between the user and the service provider.

5.3. Warranties and Liability

Warranties for services rendered are provided directly by service providers according to their specific conditions. DailyDriven does not offer additional warranties and is not liable for the quality of services provided by partners.

5.4. Prices and Payments

Prices displayed on the Platform are indicative and may vary depending on each vehicle's specifics. The final price and payment terms are established directly with the service provider.

6. User-Generated Content

6.1. Forum and Community

Users may post content in forum, comments, and reviews sections. Responsibility for posted content lies entirely with the authors.

6.2. Prohibited Content

Posting content that:

  • Violates applicable legislation
  • Is defamatory, libelous, or threatening
  • Contains hate speech or discrimination
  • Infringes copyright or intellectual property rights
  • Contains spam, unsolicited advertising, or malicious links
  • Contains personal information of third parties without consent
  • Is obscene, vulgar, or inappropriate

6.3. Moderation

We reserve the right to:

  • Moderate, edit, or delete any content that violates the rules
  • Correct grammatical errors without changing the message's meaning
  • Suspend or restrict access for users who violate the rules

6.4. Content License

By posting content on the Platform, you grant DailyDriven a non-exclusive, free, transferable, and sublicensable license to use, reproduce, modify, and distribute the content for the purpose of operating and promoting the Platform.

7. Copyright and Intellectual Property

7.1. Content Ownership

The Site's content (text, graphics, photographs, logos, design, and any other materials) is protected by copyright law and is the property of DailyDriven or its partners/licensors.

"DailyDriven" is a registered trademark owned by DailyDriven United S.R.L.

7.2. Permitted Use

You are authorized to view, print, and transmit information from the Site only for personal, non-commercial purposes, provided you:

  • Retain all copyright and other proprietary notices
  • Do not modify the content
  • Do not use the content for commercial purposes

7.3. Prohibited Use

The following is prohibited:

  • Attempting to interfere with server or network operation
  • Flooding, DoS attacks, or any other form of sabotage
  • Using email addresses for spam or scams
  • Creating fake accounts or impersonating others
  • Any fraudulent or illegal activity

8.3. Sanctions

Violating the rules may result in:

  • Temporary account suspension
  • Permanent account suspension
  • Reporting to competent authorities
  • Legal action for damages

9. Limitation of Liability

9.1. Service Availability

The Site is provided "as is" and "as available." We do not guarantee that:

  • Defects will be promptly corrected
  • The Site or servers are free of viruses or harmful components

9.3. Liability Exclusions

To the extent permitted by law, DailyDriven is not liable for:

  • Direct, indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from use or inability to use the Platform
  • Actions or omissions of users or third parties

9.4. Applicable Limitations

Our total liability to you shall not exceed the amount paid by you for our services in the last 12 months, or if you have not paid anything, the amount of 500 RON.

10. Indemnification

You agree to indemnify and hold harmless DailyDriven, its employees, directors, and partners from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the Platform
  • Your breach of these Terms and Conditions
  • Your infringement of third-party rights
  • Content you have posted

11. Privacy and Data Protection

11.1. Privacy Policy

The collection and processing of personal data is carried out in accordance with the Privacy Policy and Regulation (EU) 2016/679 (GDPR).

11.2. Cookies

We use cookies and similar technologies in accordance with the Cookie Policy.

The Site may contain links to third-party sites. We are not responsible for:

  • The content or practices of such sites
  • Their availability or functionality
  • Any damages resulting from accessing them

  • Service terms are available throughout the entire business relationship
  • Changes to terms are communicated at least 15 days before application
  • Listing ranking criteria are explained in specific regulations
  • An internal complaints handling system exists

14.2. Complaints System

Business users may file complaints regarding:

  • Non-compliance with DailyDriven's obligations
  • Service operation
  • Measures taken against the account

15. Applicable Law and Jurisdiction

15.1. Applicable Law

These Terms and Conditions are governed by Romanian law.

15.2. Dispute Resolution

For consumers: In case of dispute, you may use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

  • The National Authority for Consumer Protection (ANPC)
  • Competent Romanian courts

For business users: Disputes shall be settled amicably or, failing that, by competent courts in Bucharest, Romania.

16. Force Majeure

DailyDriven is not liable for non-performance or delayed performance of obligations due to force majeure circumstances, including but not limited to: natural disasters, wars, acts of terrorism, pandemics, strikes, network or service provider interruptions.

17. Final Clauses

17.1. Severability

If any provision of these Terms is declared null or unenforceable, the remaining provisions shall remain in effect.

17.2. Waivers

Failure to exercise or delayed exercise of a right does not constitute a waiver of that right.

17.3. Assignment

You may not assign or transfer the rights or obligations under these Terms without our written consent. We may assign these Terms to any successor or assignee of our business.

17.4. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Cookie Policy, and specific Marketplace regulations, constitute the entire agreement between you and DailyDriven.

18. Amendments to Terms

18.1. Right to Modify

We reserve the right to modify these Terms and Conditions at any time. Changes take effect upon publication on the Site.

18.2. Notification of Changes
